Terms of Service

1. Purpose

These Terms of Service (hereinafter "ToS") define the terms and conditions of use of the Switchring™ mobile application (hereinafter "the Application"), published by Captain Submit.

The Switchring™ Application allows users to intelligently manage their smartphone notifications, switch between different modes (Work, Relax, Rest), customize their ringtones, and never miss important calls.

2. Acceptance of the ToS

Using the Application implies full and complete acceptance of these ToS. If you do not accept these terms, please do not use the Application.

3. Access to the Application

The Application is available for free in its Freemium version. A Premium version is also available with advanced features through a paid subscription.

The Application is available on iOS and Android platforms. The user is responsible for having compatible equipment and an Internet connection to access the Application.

4. Account Creation

To use certain features of the Application, the user must create an account by providing accurate and up-to-date information.

The user agrees to maintain the confidentiality of their login credentials and is responsible for all activities performed under their account.

5. Application Features

5.1 Free Version

• Notification management for installed applications
• Manual switching between different modes
• Basic ringtones
• Basic statistics

5.2 Premium Version

• No advertisements
• Smart modes with automatic switching (Work, Relax, Rest)
• Premium ringtones and access to all themes
• Custom ringtones with text and sound creation
• Advanced statistics over several months
• Parental control to manage children's notifications remotely
• Automatic SMS response for emergency calls
• Multi-device synchronization
• Priority support 7 days a week

6. Premium Subscription

The Premium subscription is available in different plans:

• Monthly subscription at €1.50 excl. tax
• Semi-annual subscription at €7.50 excl. tax (25% savings)
• Annual subscription at €11.50 excl. tax (33% savings)
• Family plans available (from €29.50 to €49.50 excl. tax per year)

Subscriptions are automatically renewed unless cancelled by the user at least 24 hours before the end of the current period.

7. Permissions and Access

The Application requires certain permissions to function properly:

• Access to notifications to manage alerts
• Authorization to display persistent notifications
• Access to the list of installed applications
• Permission to run background services

8. Intellectual Property

All elements of the Application (texts, images, sounds, logos, trademarks, etc.) are the exclusive property of Captain Submit or its partners.

Any unauthorized reproduction, representation, modification, or exploitation is strictly prohibited.

9. Liability

Captain Submit strives to ensure the availability and proper functioning of the Application. However, Captain Submit cannot guarantee that the Application will be free of errors or interruptions.

The user uses the Application at their own risk. Captain Submit shall not be held liable for any direct or indirect damages resulting from the use or inability to use the Application.

10. Modification of the ToS

Captain Submit reserves the right to modify these ToS at any time. Users will be informed of any significant changes. Continued use of the Application after modification constitutes acceptance of the new ToS.

11. Termination

The user may terminate their account at any time by deleting the Application or contacting support. Captain Submit reserves the right to suspend or delete an account in case of violation of these ToS.

12. Applicable Law and Jurisdiction

These ToS are governed by French law. In case of dispute, and after an attempt at amicable resolution, French courts shall have sole jurisdiction.
